1. General Terms and Conditions of Sale for online purchases made on the website www.quellilainitaly.com

1.1 To date, the company is considered to be one of the most productive and appreciated footwear companies on the national scene. This is particularly due to the quality of its products and price competitiveness. Quellilainitaly also offers its customers the experience of online shopping through its website, with the aim of providing a wide range of models and with the advantages of a safe and simple online purchase.

The company Otisopse Web S.r.l. Via Guglielmo Melisurgo, 15 - 80133 - Naples, P.Iva: 08490801217 ("Otisopse") invites users to read these General Conditions of Sale (hereinafter "GTC") governing the purchase of products and the management of any orders placed on the site www.quellilainitaly.com (the "Site).

1.2 On the Site are offered for sale only products branded Quellilainitaly, which users interested in buying (hereinafter "Customer / Customers") can buy by following the procedures of sale described below and implemented on the Site.

2. Conclusion of contract and delivery of products

2.1 To proceed with the purchase of products on the Site is necessary to register the Customer to the same, after having read the privacy policy and acceptance of the GCS of the same.

2.2 Each order placed on the Site implies the conclusion of a contract of sale concluded between the Customer and Quellilainitaly.

2.3 By clicking on the "Buy" or "Place Order" button, the Customer places a binding order for the items contained in the virtual shopping cart. If the existing funds on the indicated account are sufficient for the purchase and the bank details provided are valid, the Bank will immediately send confirmation of the debit of the transaction to Quellilainitaly.

Customers are shown and sent simultaneously, by e-mail, an order code and a payment transaction code with all the details of the purchase.

The contract of sale is concluded between Quellilainitaly and the customer only when the latter has received confirmation of the order by e-mail.

If the Customer does not receive any order confirmation within the next 24 hours, the relevant order shall be deemed to have been rejected by Quellilainitaly and, therefore, without effect. In this case, if you have any questions about your order, please contact customer service at the e-mail address listed in Article 10.1 below.

2.4 Orders will be shipped as soon as Quellilainitaly receives full payment of the purchase price and any shipping costs, where specified.

2.5 If the product(s) inserted are not available, the Customer will not be able to start the purchase process.

However, in the event that, despite the unavailability of the product in stock, the system erroneously indicates the possibility of proceeding with the purchase of the goods, and the order is completed by the customer, Quellilainitaly does not assume the burden of procuring the product requested from it. The customer will be contacted by Quellilainitaly Customer Care, who will inform him of the incident.

Thatilainitaly will refund the amount paid within 7 days.

2.6 Quellilainitaly delivers within Italy, within the European Union and outside it. Delivery times are expressed in working days, meaning all those between Monday and Friday, including, with the exception of any public holidays.

3. Prices, shipping costs and delivery times

3.1 The price of the goods is expressed only in Euro.

3.2 The Customer is obliged to pay the price published on the check-out page at the time the order is sent. The price indicated is final and includes VAT and any shipping costs. Orders will be processed and / or shipped by Quellilainitaly on days from Monday to Friday, from 9:00 to 17:30. Orders placed during the weekend will be processed from the first working day after.

3.3 In particular:

- Deliveries on the Italian territory are free and shipping times vary from 3 to 5 working days;

- Shipments outside Italy, but within the European Union, have an additional cost of 15 Euro and delivery times vary from 5 to 7 working days.

- The cost of shipping and delivery times outside of Italy, and the territory of the European Union, vary depending on the country of destination, which will still be indicated on the relevant page of check-out before payment.

3.4 Please note that the delivery time and / or shipment of goods may be subject to changes not attributable to Quellilainitaly or due to events of force majeure, such as, but not limited to, strikes, natural disasters, situations outside the company, etc..

3.5 During the period of sales, promotions, events or holidays, shipments may be delayed or take longer than the will of Quellilainitaly.

4. Payment and payment

4.1 Quellilainitaly accepts payments made by credit card of the circuit Maestro, Mastercard, Visa, PayPal, Diners and PostePay.

4.2 Once Quellilainitaly has received confirmation from the bank that payment has been made, it will forward an e-mail to the Customer containing confirmation of payment and an order identification number. Once the shipment of the goods has been completed, Quellilainitaly will send the customer an additional e-mail with the data necessary to track the package.

4.3 If the existing funds on the account indicated are sufficient for the purchase and the bank details provided are valid, the bank will send instant confirmation that the transaction has been debited. Customers are shown and sent simultaneously, by e-mail, an order code and the code of the payment transaction. The full amount will be charged to your credit card at the time of purchase. (Orders are processed from Monday to Friday, with the following time: 9.00-17.30. Orders placed during the weekend will be processed from the first working day after)

4.4 In order to ensure greater protection on purchases made in e-commerce, Quellilainitaly recommends its customers to join the services Verified By Visa or Mastercard Securecode, requesting a PIN security code with which to make their purchases. In any case, the Site uses the https/ssl protocol to ensure the security of the information exchanged through it.

4.5 If the account indicated does not have the necessary funds to proceed with the purchase and the request for payment is, therefore, rejected, the contract is deemed to be for all intents and purposes not concluded.

5. Application of promotional vouchers

Promotional vouchers:

- may have a value expressed in % or a fixed amount;

- cannot be purchased by customers but are offered by Quellilainitaly as part of promotional campaigns;

- may be used for a limited period of time.

Some promotional vouchers may be applied to the entire amount of goods in the virtual cart, others, however, will only be applicable to the individual product. Promotional vouchers can be used:

- once in relation to a single order;

- within the specified period of validity.

In addition, it is possible that the possibility of using promotional coupons for the purchase of certain products is excluded or that the use of a promotional coupon is subject to a minimum amount of expenditure.

If the amount of the promotional voucher is not sufficient to cover the value of the product(s) ordered, the difference can be paid in the manner indicated in art. 4.

Promotional vouchers may not be accumulated for the same order or transferred to third parties, but may only be used if the order is finalized. Moreover, the same cannot be used retroactively.

If, during the course of the order, the customer has used a promotional coupon and the total value of the order - due to the withdrawal of the customer - is lower than the value of the promotional coupon, Quellilainitaly reserves the right to invoice the original price of the goods that remain in the possession of the customer.

Thatilainitaly may condition the use of these vouchers to the achievement of a minimum threshold of expenditure, for the calculation of which are to be considered excluding shipping costs.

6. Cancellation of the order and right of rethinking

The customer can choose to cancel his order at any time, before the delivery of the product. To exercise this right, the Customer must write an email to the address specified in art. 10.1 below. Once received the request, Quellilainitaly will cancel the order and refund the amount paid, within 14 days from the date on which Quellilainitaly received the Customer's request.

7. Right of withdrawal

7.1 Pursuant to art. 49 et seq. of the Consumer Code (Legislative Decree 206/2005), the Customer has the right to withdraw from the contract without giving any reason within, and no later than, 14 days from the day on which the Customer or a third party, other than the carrier, comes into possession of the goods purchased.

7.2 In order to properly exercise the right of withdrawal, the Customer may:

a) Use the form for withdrawal set out in Annex I, Part B, and send it by registered mail with return receipt to Otisopse S.r.l., Via Santa Teresa a Chiaia n.40/A, 80122 Naples (NA); or

b) access your reserved area and click on the appropriate tab. Through it you will access a pre-filled form that you will have to integrate with the missing and necessary information.

Following receipt of the withdrawal request, Quellilainitaly will send the customer a communication by email confirming the same.

7.3 Moreover, the Customer, within 14 days from the sending of the withdrawal request, will be obliged to send the goods back to Quellilainitaly, by means of the courier who made the delivery and at his own expense. The goods must be shipped in accordance with the following procedures:

- Correctly packed in their original packaging, undamaged, damaged or soiled and equipped with all possible accessories and documentation, and without any obvious signs of use;

- Equipped with the original transport document (present in the original packaging), so as to allow Quellilainitaly to uniquely identify the Customer (Order number, name, surname and address);

If the methods and times indicated above for the return of the goods are not respected, Quellilainitaly reserves the right not to accept the return and not to make a refund.

7.4 Following the withdrawal from this contract, Quellilainitaly will, within, and no later than, 14 days after receipt of the goods in question or receipt of proof, by the Customer, that it has been shipped, depending on which situation occurs first, to reimburse the Customer the price paid at the time of purchase, including standard shipping costs. Where the Customer, if available, has chosen a different method from the standard one, the refunded price will only cover the difference between the cost of standard shipping and that chosen by the Customer. If the use of the goods by the Customer results in damage to the product purchased, such that its value is reduced, the Customer will be liable to Quellilainitaly.

7.5 This refund will be made using the same payment instrument used by the Customer at the time of purchase. In any case, the customer will not be required to bear any cost as a result of such reimbursement, except for shipping costs for returning the goods.

7.6 In case of withdrawal concerning all the products purchased, the initial delivery costs will also be reimbursed. Otherwise, in case of a "partial" withdrawal (concerning only a part of the purchased products) the costs of the initial delivery will not be refunded.

If the above methods for withdrawal and return of goods are not respected, Quellilainitaly reserves the right not to accept the withdrawal and not to make a refund, subject to compliance with legal obligations at its expense.

8. Rendered

8.1 Return in case of damaged goods

(a) 'Damaged goods' means goods which, on a summary and rapid examination, show immediately identifiable defects.

b) The defect from which the purchased goods are affected must be reported by the customer within, and no later than, 60 days after the date of receipt of the goods, by writing to the e-mail address info@quellilainitaly.com or by registered letter with return receipt to Otisopse S.r.l., Via Santa Teresa a Chiaia n.40/A, 80122 Naples (NA);

c) The Customer shall also be obliged to return the goods in the following ways:

- Correctly packed in their original packaging, undamaged, damaged or soiled and equipped with all possible accessories and documentation, and without any obvious signs of use;

- Equipped with the original transport document (present in the original packaging), so as to allow Quellilainitaly to uniquely identify the Customer (Order number, name, surname and address);

If the methods and times indicated above for the return of the goods are not respected, Quellilainitaly reserves the right not to accept the return and not to make a refund.

d) The shipping costs of the returned goods will be borne by Quellilainitaly, which will collect the goods by its own courier.

e) The Customer will be refunded the price of the returned products and the cost of the initial shipment, within 14 days from the day of collection of the goods by Quellilainitaly. The refund will be made using the same method of payment chosen by the customer during the purchase. In case of payment by credit card or Paypal circuit, the refund will be credited to the customer's account.

9. Refunds

9.1 Refunds are credited directly through the method in which the Customer made the payment.

10. Customer Service

10.1 The Customer may contact Quellilainitaly Customer Service, which will be available from Monday to Friday, from 09:00 to 17:30, at the e-mail address info@quellilainitaly.com

10.2 Requests received outside of the above hours will be dealt with from the first working day after.

11. Warranty for product defects and non-conformities and additional information

11.1 Purchases made on the Site are subject to the rules of the Consumer Code on warranty for defects and discrepancies of products. the customer will therefore be entitled to the rights under art. 128 et seq. of the Consumer Code and these rights must be exercised within the terms of art. 132 of the same Consumer Code.

12. Applicable law and jurisdiction

12.1 Italian law (and in particular the Consumer Code - which in articles 46 to 67 regulates distance contracts - and Legislative Decree 70 of 09/04/2003 on electronic commerce) shall apply to these GCS and to the sales contracts connected to them, in the light of which they must be interpreted.

12.2 Pursuant to Article 447-bis of the Code of Civil Procedure and Article 66-bis of the Consumer Code, Legislative Decree 206/2005, in the event of a dispute arising between the parties regarding the interpretation, termination and/or application of this contract, the judge of the place of residence or domicile of the consumer, if located in the territory of the State, shall have territorial jurisdiction. If, on the other hand, the consumer is resident or domiciled outside the Italian territory, the Court of Naples shall have exclusive jurisdiction over disputes concerning the matters previously mentioned.
