1. General Conditions of Sale for purchases made online on the website www.quellilainitaly.com
1.1 Quellilà offers its customers the online shopping experience through its website, with the aim of providing a wide range of models and with the advantages of a safe and simple online purchase.

Otisopse Web S.r.l. Via Guglielmo Melisurgo, 15 - 80133 - Naples, VAT number: 08490801217 ("Otisopse") invites users to read these General Conditions of Sale (hereinafter "GCS") which regulate the purchase of products and the management of any orders placed on the site www.otisopse.com (the "Site).

1.2 Only Otisopse and Quellilà branded products are offered for sale on the Site, which users interested in purchasing (hereinafter "Customer / Customers") can purchase by following the purchase and sale procedures illustrated below and implemented on the Site.

2. Conclusion of the contract and delivery of the products
2.1 To proceed with the purchase of products on the Site, the Customer must register with the same, after having read the privacy policy and accepting the GCS of the same.

2.2 Each order placed on the Site implies the conclusion of a sales contract concluded between the Customer and Quellilà

2.3 By clicking on the "Buy" or "Place Order" button, the Customer places a binding order for the items contained in the virtual shopping cart. If the existing funds on the indicated account are sufficient for the purchase and the bank details provided are valid, the Bank will instantly send the confirmation of the debit of the transaction to Otisopse.

Customers are shown and sent simultaneously, via e-mail, an order code and a payment transaction code with all the purchase details.

The sales contract is concluded between Quellilà and the Customer only when the latter has received the order confirmation by e-mail.

If the Customer does not receive any confirmation of the order within the term of the next 24 hours, the related order must be considered rejected by Otisopse and, therefore, ineffective. In this case, for any doubts relating to the order, please contact customer service at the e-mail address referred to in Article 10.1, below.

2.4 Orders will be shipped as soon as Otisopse has received full payment of the purchase price and any shipping costs, where specified.

2.5 If the inserted product / s are not available, the Customer will not be able to start the purchase procedure.

However, in the event that, despite the unavailability of the product in stock, the system incorrectly indicates the possibility of proceeding with the purchase of the goods, and the order is completed by the Customer, Otisopse does not assume the burden of procuring the product requested from the same. The Customer will be contacted by Otisopse Customer Care, which will inform them of the problem that has occurred.

Otisopse will refund the amount paid within 7 days.

2.6 Otisopse makes deliveries within Italy, within the European Union and outside it. Delivery times are expressed in working days, meaning all those between Monday and Friday, inclusive, with the exception of any holidays.

3. Prices, shipping costs and delivery times
3.1 The price of the goods is expressed only in Euros.

3.2 The Customer is required to pay the price published on the check-out page at the time the order is sent. The indicated price is final and inclusive of VAT and any shipping costs. Orders will be processed and / or shipped by Otisopse from Monday to Friday, from 9:00 to 17:30. Orders placed during the weekend will be processed starting from the first following working day.

3.3 In particular:

• Deliveries on the Italian territory are free and shipping times vary from 3 to 5 working days;

• Shipments outside Italy, but within the European Union, involve an additional cost of 15 Euros and delivery times vary from 5 to 7 working days.

• The cost of shipping and delivery times outside Italy, and from the territory of the European Union, vary in relation to the country of destination, which will in any case be indicated on the relevant check-out page before payment.

3.4 Please note that the delivery and / or shipment times of the goods may undergo variations not attributable to Otisopse or due to force majeure events, such as, by way of example but not limited to, strikes, natural disasters, situations external to the company, etc. etc.

3.5 During the period of sales, promotions, events or holidays, shipments may be delayed or take longer completely independent of quellilà 4. Payment
4.1 Otisopse accepts payments made by Maestro, Mastercard, Visa, PayPal, Diners and PostePay credit cards.

4.2 Once the payment has been confirmed by the bank, Otisopse will forward to the Customer an e-mail containing the confirmation of the payment and an identification number of their order. Once the shipment of the goods has been completed, Otisopse will send the Customer an additional e-mail with the data necessary for the traceability of the package.

4.3 If the existing funds on the indicated account are sufficient for the purchase and the bank details provided are valid, the bank will instantly send the confirmation of the debit of the transaction. Customers are simultaneously shown and sent, via e-mail, an order code and the payment transaction code. The full amount will be charged to your credit card at the time of purchase. (Orders are processed from Monday to Friday, with the following hours: 9.00-17.30. Orders placed during the weekend will be processed starting from the first following working day)

4.4 In order to guarantee greater protection on purchases made in the e-commerce sector, Otisopse recommends its Customers to join the Verified By Visa or Mastercard Securecode services, requesting a PIN security code with which to make their purchases. In any case, the Site uses the https / ssl protocol, to guarantee the security of the information exchanged through it.

4.5 If the indicated account does not have the necessary funds to proceed with the purchase and the payment request is, therefore, rejected, the contract is understood to be for all intents and purposes not concluded.

5. Application of promotional vouchers
Promotional vouchers:

• they can have a value expressed in% or at a fixed amount;

• cannot be purchased by customers but are offered by quellilà as part of promotional campaigns;

• can be used for a limited period of validity.

Some promotional vouchers may be applied to the full amount of the goods in the virtual cart, others, however, will only be applicable to a single product. Promotional vouchers can be used:

• only once in relation to a single order;

• within the specified validity period.

Furthermore, it is possible that for the purchase of some products the possibility of using promotional vouchers is excluded or that the use of a promotional voucher is subject to a minimum amount of expenditure.

If the amount of the promotional voucher is not sufficient to cover the value of the product (s) ordered, the difference can be paid using the methods indicated in art. 4.

Promotional vouchers cannot be combined for the same order or transferred to third parties, but can only be used if the order is finalized. Furthermore, they cannot be used retroactively.

If, in the course of the order, the customer has used a promotional voucher and the total value of the order - due to the customer's withdrawal - should be lower than the value of the promotional voucher, Otisopse reserves the right to invoice the original price of the goods that remain in the possession of the customer.

Otisopse may condition the use of the aforementioned vouchers to the achievement of a minimum spending threshold, for the calculation of which shipping costs are to be considered excluded.

6. Cancellation of the order and right of reconsideration
The Customer can choose to cancel his order at any time before the delivery of the product. To exercise the aforementioned right, the Customer must write an email to the address specified in art. 10.1 below. Once the request is received, Otisopse will cancel the order and refund the amount paid, within 14 days from the date on which Otisopse received the Customer's request.

7. Right of withdrawal
7.1 Pursuant to art. 49 and ss. of the Consumer Code (Legislative Decree 206/2005) the Customer has the right to withdraw from the contract without giving any reason within, and no later than, 14 days from the day on which the Customer or a third party, other than the carrier, enters in possession of the purchased good.

7.2 In order to properly exercise the right of withdrawal, the Customer can:

a) Use the withdrawal form referred to in Annex I, Part B, and send it by registered letter with return receipt to Otisopse S.r.l., Via Santa Teresa a Chiaia n.40 / A, 80122 Naples (NA); or

b) access your private area and click on the appropriate tab. Through the same, he will access a pre-filled form that he will have to integrate with the missing and necessary information.

Following receipt of the withdrawal request, Otisopse will send the Customer a communication by email confirming the same.

7.3 The Customer Furthermore, within 14 days of sending the request for withdrawal, he will be required to return the goods to Otisopse, by means of the courier who made the delivery and at his own expense. The goods must be sent in compliance with the following methods:

• Properly packaged in their original packaging, not ruined, damaged or soiled and equipped with any accessories and documentation, and without obvious signs of use;

• Equipped with the original transport document (present in the original packaging), in order to allow Otisopse to uniquely identify the Customer (Order number, name, surname and address);

If the methods and times indicated above for the return of the goods are not respected, Otisopse reserves the right not to accept the return and not to refund.

7.4 Following the withdrawal from this contract, Otisopse will, no later than 14 days after receipt of the goods in question or receipt of proof by the Customer that the same has been shipped, depending on which situation occurs first, to reimburse the customer the price paid at the time of purchase, including standard shipping costs. Where the Customer, if available, has chosen a method other than the standard one, the refunded price will only cover the difference between the cost of the standard shipment and that chosen by the Customer. If the use of the goods by the Customer results in damage to the purchased product, such that its value is decreased, the Customer will be liable to Otisopse.

7.5 This refund will be made using the same payment instrument used by the Customer during the purchase. In any case, the Customer will not be required to incur any costs as a consequence of this reimbursement, except for the shipping costs for returning the goods.

7.6 In case of withdrawal concerning all the products purchased, the initial delivery costs will also be reimbursed. Otherwise, in the event of a "partial" withdrawal (concerning only a part of the products purchased), the costs of the initial delivery will not be reimbursed.

If the aforementioned modalities for the withdrawal and the return of the goods are not respected, Otisopse reserves the right not to accept the withdrawal itself and not to make the refund, without prejudice to compliance with the legal obligations against it.

8. Return
8.1 Return in case of damaged goods

a) Damaged goods are defined as goods which, upon a quick and brief examination, present immediately identifiable defects.

b) The defect affecting the purchased goods must be reported by the Customer no later than 60 days after the date of receipt of the goods, by writing to the e-mail address info@otisopse.com or by registered letter with return receipt. to Otisopse web Srl, Via Guglielmo Melisurgo 15 n.40 / A, 80133 Naples (NA);

c) The Customer will also be required to return the goods in the following ways:

• Properly packaged in their original packaging, not ruined, damaged or soiled and equipped with any accessories and documentation, and without obvious signs of use;

• Equipped with the original transport document (present in the original packaging), in order to allow Otisopse to uniquely identify the Customer (Order number, name, surname and address);

If the methods and times indicated above for the return of the goods are not respected, Otisopse reserves the right not to accept the return and not to refund.

d) The shipping costs of the returned goods will be borne by Otisopse, which will collect the goods by means of its own courier.

e) The Customer will be reimbursed for the price of the returned products and the cost of the initial shipment, within 14 days from the day of collection of the goods by Otisopse. The refund will be made through the same payment method chosen by the Customer during the purchase. In case of payment by credit card or via Paypal, the refund will be made by crediting the amount in question to the customer's account.

9. Refunds
9.1 Refunds are credited directly through the method in which the Customer made the payment.

10. Customer Service
10.1 The Customer can contact Otisopse Customer Service, which will be active from Monday to Friday, from 09:00 to 17:30, at the e-mail address info@otisopse.com

10.2 Requests received outside the aforementioned hours will be processed starting from the first following working day.

11. Warranty for defects and non-conformities of the products and additional information
11.1 Purchases made on the Site are subject to the rules of the Consumer Code regarding warranty for product defects and discrepancies. The Customer will therefore be granted the rights referred to in art. 128 and following of the Consumer Code and these rights must be exercised under the terms of art. 132 of the same Consumer Code.

12. Applicable law and competent court
12.1 Italian law (and in particular the Consumer Code - which in articles 46 to 67 governs distance contracts - and Legislative Decree 70 of 09/04 are applied to these GCS and the related sales contracts). / 2003 on electronic commerce) in the light of which they must be interpreted.

12.2 Pursuant to Article 447bis of the Code of Civil Procedure and art. 66-bis Consumer Code, Legislative Decree. 206/2005, in the event of a dispute arising between the parties regarding the interpretation, termination and / or application of this contract, the judge of the place of residence or domicile of the consumer, if located in the territory of the State. If, on the other hand, the consumer is resident or domiciled outside the Italian territory, the Naples court will be exclusively competent for disputes concerning the matters mentioned up to now.
